Terms & Conditions of Service

 The following terms and conditions (“the Conditions”) are the terms on which Watson Construction Group Ltd (“the Company”) supplies services and materials (“the Services”) and supersede all previous terms relating to those Services.


1. Price and Payment

1.1 The price (inclusive of VAT where applicable) for the Services and any materials (“the Price”) shall be as stated in the Company’s quotation or estimate.


Private / Domestic Clients

1.2 A deposit of between 25% and 50%, or payment of material costs, shall be payable upon acceptance of the quotation, as specified by the Company.

1.3 The balance of the Price shall be due immediately upon completion of the Services.

1.4 Deposits paid by private or domestic clients are non-refundable in the event of cancellation by the Client.

1.5 If payment of the balance is not received on completion, the Company reserves the right to:

  • Charge statutory interest on overdue amounts;
     
  • Recover reasonable costs of debt collection;
     
  • Suspend further work until payment is received.
     

Commercial / Public Sector Clients

1.6 Unless otherwise agreed in writing, payment of the Price shall be made within 30 days of the date of invoice.

1.7 If payment is not made by the due date, the Company reserves the right to:

  • Charge statutory interest on overdue amounts;
     
  • Recover reasonable costs of debt collection;
     
  • Suspend all Services until payment is received, in accordance with the Housing Grants, Construction and Regeneration Act 1996 where applicable.
     

Day Rates & Site Readiness

1.8 Where works are undertaken on a day-rate basis, the applicable rate shall be as stated in the quotation.

1.9 If, upon attendance, the site is deemed unready, inaccessible, or unsafe, the Company reserves the right to:

  • Charge its standard day rate per person on site;
     
  • Reschedule works until the site meets the minimum readiness and safety standards.
     

2. Services

The description and scope of the Services shall be as set out in the quotation provided by the Company and accepted by the Client.


3. Carrying Out of the Services

3.1 The Company shall carry out the Services at the site address and on the agreed dates as stated in the quotation or contract documents.

3.2 The Client shall provide safe, uninterrupted access to the site and ensure the site is ready for the Services to commence.


4. Site Access, Control and Security

4.1 Upon commencement of the Services, the Client grants the Company a licence to occupy and control the work area for the duration of the Services.

4.2 The Company shall have exclusive possession of the work area insofar as is reasonably necessary to carry out the Services safely, efficiently, and in compliance with health and safety legislation.

4.3 The Client shall not interfere with, obstruct, or permit third-party access to the work area without the Company’s prior consent.

4.4 The Client shall ensure the site is secure and, where reasonably practicable, provide suitable measures including lockable access, fencing, alarms, or other appropriate security arrangements.

4.5 The Company shall not be responsible for loss, theft, or damage to its tools, equipment, or materials caused by inadequate site security, unauthorised access, or third-party actions beyond the Company’s reasonable control.

4.6 The Company shall not be deemed to have any legal or beneficial ownership interest in the site and shall vacate the work area upon completion or termination of the Services.


5. Ownership of Materials

5.1 Ownership of all materials supplied by the Company shall remain with the Company until paid for in full.

5.2 The Client shall take reasonable care of such materials while in their possession or on their site. Any Damage caused to materials in the Client possesion, the Client shall be liable


6. Cancellation and Termination

6.1 The Client may not cancel the order without the Company’s written agreement.

6.2 Where cancellation occurs without agreement, the Client shall be liable for all reasonable costs, losses, and expenses incurred by the Company up to the date of cancellation.

6.3 Where the Company cancels the contract, it shall be liable only for reasonable and evidenced losses directly arising from such cancellation.

6.4 Where cancellation occurs within 5 business days of the start date the Client will be liable to cover loss of earnings at our standard day rate


7. Limitation of Liability

7.1 The Company’s total liability arising out of or in connection with the Services shall be limited to the lower of:

the total Price paid under the Contract; or

the level of insurance held by the Company at the time of the event giving rise to the claim.

7.2 The Company shall not be liable for any indirect or consequential loss.


8. Third Party Rights

Nothing in these Conditions shall confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.


9. Governing Law and Jurisdiction

These Conditions shall be governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

Health and Saftey Policy

 Policy Statement  At Watson Construction Group Ltd, we are committed to providing a safe and healthy working environment  for our employees, contractors, visitors, and the public. We recognize the importance of effective  health and safety management to protect our employees and minimize risks associated with our  carpentry and construction activities. This policy outlines our commitment to maintaining the  highest health and safety standards.  


Responsibilities  


Management: The management of Watson Construction Group Ltd is responsible for:


1. Establishing and promoting a culture of health and safety within the organization.


2. Providing adequate resources to implement and maintain health and safety measures.


3. Ensuring compliance with all relevant health and safety legislation.


4.  Setting objectives and targets to continually improve health and safety performance.


5. Regularly reviewing and updating this policy.  


Employees and Contractors: All employees and contractors are responsible for:  


1.  Complying with all health and safety policies, procedures, and regulations.


2. Reporting any hazards, incidents, or near misses to their immediate supervisor.


3.  Taking reasonable care for their safety and the safety of others.


4. Using provided personal protective equipment (PPE) as required.  


Health and Safety Measures  


Watson Construction Group Ltd will:  


1. Identify hazards associated with carpentry and construction work and assess the risks  involved. 

 

2. Develop and implement control measures to mitigate identified risks.


3. Provide adequate training, information, and supervision to employees to ensure their  competence in managing health and safety.  


4. Maintain and inspect tools, equipment, and machinery regularly to ensure their safety


5. Promote and encourage a reporting culture, where employees are encouraged to report  safety concerns and incidents without fear of reprisal.  


6.  Ensure that all employees and contractors have access to first-aid facilities and appropriate  first-aid training.  


7.  Regularly review and update the health and safety policy and procedures.  


Emergency Procedures  


Watson Construction Group Ltd will have clear and well-communicated emergency procedures in place,  including but not limited to:  

1.   Fire evacuation plans.    


2.   First-aid procedures.


3.  Reporting and managing accidents and near-miss incidents.


4. .  Procedures for handling hazardous materials



Review and Continual Improvement 


 This Health and Safety Policy will be reviewed at regular intervals or as necessary to ensure its  effectiveness and compliance with changing regulations. The management will conduct reviews to  assess the effectiveness of health and safety measures and make improvements where needed.
